This End User License Agreement ("EULA") is a legal agreement between you (an individual or an organization) and Le Quoc Tuan ("the developer") regarding all software applications published by the developer on the Apple App Store, together with any updates, related documentation, and accompanying media (collectively, the "Software").
By downloading, installing, or using the Software, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA. If you do not agree with any part of these terms, please do not download, install, or use the Software.
1 License grant
Subject to your compliance with this EULA, the developer grants you a non-exclusive, non-transferable, revocable license to install and use the Software on devices that you own or control, for personal use or for internal use within your organization, in accordance with the Usage Rules published by Apple Inc.
You are responsible for ensuring that your device meets the minimum system requirements and for any costs incurred from network connectivity, mobile data, or any other expenses associated with your use of the Software.
2 Restrictions
You agree not to:
- Copy, distribute, sell, rent, or lease the Software.
- Decompile, reverse-engineer, disassemble, or otherwise attempt to derive the source code of the Software.
- Modify, alter, or create derivative works based on the Software.
- Remove, alter, or obscure any copyright notices, trademarks, or other proprietary notices contained in the Software.
- Use the Software for any unlawful, fraudulent, or harmful purpose.
- Use the Software to develop a competing product.
- Circumvent any technical measures designed to restrict access to the Software.
3 Intellectual property
The Software is licensed, not sold. Le Quoc Tuan retains all right, title, and interest in and to the Software, including all related intellectual-property rights: copyrights, trademarks, trade secrets, patents, and any improvements, modifications, or derivative works.
All rights not expressly granted in this EULA are reserved by the developer.
4 Updates and changes
The developer may provide updates, patches, or new features for the Software. These updates may be installed automatically or with your consent, depending on your device configuration. All updates are subject to the terms of this EULA unless accompanied by a separate agreement.
5 User content
If the Software allows you to upload, store, or create content, you retain full ownership of your content. You are solely responsible for the legality, accuracy, and appropriateness of any content you provide.
6 Disclaimer of warranties
The Software is provided "AS IS" and "AS AVAILABLE" without any warranty of any kind, whether express or implied. The developer does not warrant that the Software will meet all of your requirements, operate without interruption, be entirely error-free, or be compatible with every device.
7 Limitation of liability
To the maximum extent permitted by applicable law, Le Quoc Tuan shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of data, business interruption, or any other commercial damages arising out of or related to the use (or inability to use) the Software.
8 Indemnification
You agree to indemnify and hold harmless Le Quoc Tuan from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of this EULA or your violation of any third-party rights.
9 Termination
This EULA takes effect from the moment you install the Software and remains in effect until terminated. Your rights under this EULA will terminate automatically if you breach any of its terms. Upon termination, you must stop all use of the Software and delete all copies from your devices.
The developer reserves the right to discontinue, update, or stop supporting the Software at any time without prior notice.
10 Third-party services
The Software may integrate third-party services, APIs, or materials (for example, the Apple App Store, Firebase, advertising services). Your use of those services is also governed by their own terms. The developer is not responsible for any third-party services.
11 Export compliance
You agree to comply with all applicable domestic and international laws and regulations relating to the Software, including export-control laws and sanctions issued by the United States and other competent authorities.
12 Governing law
This EULA is governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to conflict-of-laws principles. Any dispute arising out of or relating to this EULA shall be resolved by the competent courts in Vietnam.
13 Entire agreement
This EULA, together with the Privacy Policy, constitutes the entire agreement between you and Le Quoc Tuan with respect to the Software and supersedes all prior or contemporaneous agreements, whether oral or written. If any provision of this EULA is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14 Changes to the terms
The developer reserves the right to modify this EULA at any time. New versions will be posted on this page and will take effect immediately upon publication. Your continued use of the Software after such changes constitutes your acceptance of the new terms.
